Rhode Island Supreme Court Affirms McManus Conviction

In State v. McManus, the Rhode Island Supreme Court held that when an out-of-court statement is admissible under a recognized exception to the hearsay rule, its admission will be upheld on appeal notwithstanding any error in the trial judge’s ruling.

The case was especially news-worthy since the defendant, Joseph McManus, was found guilty of soliciting Vincent Arruda to murder Attorney General Jeffrey Pine and soliciting Robert Smith to murder the Attorney General and to feloniously assault Assistant Attorney General Margaret Lynch.  The Supreme Court affirmed McManus’ conviction.
